Perlindungan Hukum Pemilik Hak Merek Berdasarkan First to File Principle: Konflik Hukum Skyworth dan Skyworth-RGB

Abstract
Skyworth Group Co., Ltd.,asal negara China mengajukan pendaftaran merek miliknya yaitu SKYWORTH ke Direktorat Merek di Indonesia, namun statusnya di tolak dengan alasan sudah ada merek yang serupa yaitu SKYWORTH-RGB telah terdaftar terlebih dahulu atas nama orang lain. Penelitian ini adalah penelitian normatif. Pengumpulan data melalui studi pustaka dan studi dokumen. Pengolahan data dengan cara pemeriksaan, penyusunan dan sistematisasi data. Selanjutnya dilakukan analisis secara kualitatif. Hasil penelitian dan pembahasan yaitu berdasarkan sistem first to file principle pihak yang paling berhak atas merek Skyworth adalah pihak Skyworth Group Co., Ltd., milik China. Putusan MA No. 32 PK/Pdt.Sus-HKI/2018 telah sesuai dengan sistem first to file principle. Akibat hukum atas putusan ini berupa pembatalan dan pencoretan merek Skyworth-RGB milik Linawaty Hardjono dan Direktorat Jenderal Hak Kekayaan Intelektual Direktorat Merek diwajibkan untuk menerbitkan sertifikat merek Skyworth atas nama Skyworth Group Co., Ltd.
