UPHOLDING THE SUPREMACY OF THE CONSTITUTION IN THE SCOPE OF INDONESIAN CONSTITUTIONAL DEVELOPMENT

Abstract

Implementing constitutional supremacy in Indonesia still faces challenges, as seen from the polemics between the executive, legislative, and judicial institutions. So it is necessary to analyze the enforcement of the supremacy of the constitution by the mandate of the 1945 Constitution in the development of Indonesian state administration. The discussion will focus on the appointment of the supremacy of the constitution in the context of the rule of law and constitutional democracy. This research uses the normative juridical method. The results show that there is still a mistake in the interpretation between constitutional supremacy and parliamentary supremacy, this is due to the involvement of certain group interests. The supremacy of the constitution has not been fully reflected in the practice of Indonesian state administration, so it requires harmony between institutions and consistency to uphold the constitution.
