Abstract

The Indonesian Constitution guarantees the protection of citizens' fundamental rights through the principle of a rule-of-law state. This study aims to ensure the protection and fulfillment of constitutional rights enshrined in the Constitution by employing a normative legal research method with legislative and conceptual approaches. The findings highlight three key points: first, the implementation of a Constitutional Complaint aligns with the principle of a democratische rechtsstaat to restore constitutional rights; second, a constitutional amendment is required to expand the Constitutional Court's authority under Article 24C of the 1945 Constitution of the Republic of Indonesia; and third, a new Constitutional Court Regulation (PMK) specifically addressing the procedural framework for Constitutional Complaints needs to be established. These measures are expected to enhance the protection of constitutional rights, reinforce the rule-of-law principle, and solidify the Constitutional Court’s legitimacy as the guardian of the Constitution.
