Abstract

The challenges of developing countries mean that the sea, air and space sectors are always undervalued. This can be seen in the Indonesian constitution, which only contains a very small part of the blue element. In fact, much of the country's wealth is found and must be developed in this element. This analysis is important to see Indonesia's status quo and its comparison with other countries. The method used is normative legal research with a comparative approach and legislation. The analysis found that there are still lags such as boundaries that have not been concretised, lack of optimisation, and overlapping regulations. Compared to countries such as Japan, Singapore and the Philippines that have succeeded in building strong regulations regarding the sea. So that it contributes very rapidly. Findings regarding studies related to the blue constitution are still very difficult to find in Indonesia. So the conclusion is that attention is needed through revision of the 1945 Constitution article, especially article 33 paragraph (3) and strengthening regulations to optimise the blue element.
