Pertanggungjawaban Pidana Notaris atas Akta yang Mengandung Muatan Pemalsuan

Abstract: This study aims to determine the criminal liability for a deed containing forgery in its issuance. This research is normative legal research using statutory, case, and conceptual approaches. The results show that the criminal liability against a notary if there is an error in the deed he made must meet the elements of committing a crime, have the ability to be responsible, intentionally or negligently, and there is no excuse for forgiveness. However, sentencing a Notary based on Article 266 paragraph (1) of the Indonesian Criminal Code is inappropriate because the elements of these articles are not fulfilled. The elements of a criminal act are difficult to prove when associated with a notary's function and authority, and mistakes in applying the law will criminalize the notary's duties. Abstrak: Penelitian ini bertujuan untuk mengetahui pertanggungjawaban pidana notaris atas akta yang mengandung muatan pemalsuan dalam penerbitannya. Penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa pertanggungjawaban pidana terhadap notaris jika terjadi kesalahan pada akta yang dibuatnya harus memenuhi unsur-unsur melakukan tindak pidana, memiliki kemampuan untuk bertanggung jawab, dengan kesengajaan atau kealpaan, dan tidak ada alasan pemaaf. Menjatuhkan hukuman terhadap seorang Notaris yang membuat akta berdasarkan Pasal 266 ayat (1) KUHP, merupakan hal yang tidak tepat, karena unsur-unsur dari pasal-pasal tersebut tidak terpenuhi dan unsur-unsur perbuatan pidana sulit dibuktikan bila dikaitkan dengan fungsi dan kewenangan notaris, dan kekeliruan dalam menerapkan hukum akan berakibat kriminalisasi terhadap tugas notaris.Downloads
