WASTE MANAGEMENT BUDGET FROM THE PERSPECTIVE OF THE CONSTITUTIONAL RIGHTS OF THE PEOPLE OF MAKASSAR CITY

Abstract

Waste management in Makassar City faces major challenges, especially at Tamangapa Landfill which has experienced overcapacity since 2019 and still applies an open dumping system that pollutes the environment. This condition is exacerbated by the lack of budget allocation and weak effective management, which has the potential to violate the constitutional rights of citizens to a good living environment as stipulated in Article 28H paragraph (1) of the 1945 Constitution. This study aims to analyze the constitutional management of the waste budget in Makassar City and assess public participation in budget planning and allocation. Using the normative-juridical method through analysis of laws and regulations, the results show that although there are supporting legal instruments, their implementation is still limited due to inadequate budget allocations. This research further proposes the PAIR (Participation, Improvement, Reform) model as a framework for creating inclusive, accountable, and sustainable waste governance in line with the spirit of regional development.
